Terms of Service.
General
These Terms of Service govern your use of all services provided by hozt.org, a hosting company based in Amsterdam, Netherlands. By accessing or using our services, you agree to be bound by these terms. If you do not agree, you must discontinue use immediately.
Services
hozt.org provides virtual private servers (VPS), dedicated servers, web hosting, domain registration, and storage services. VPS and hosting services are typically provisioned within minutes of payment confirmation. Dedicated servers are deployed within 24 to 72 hours depending on configuration and availability. Domain registrations are processed in real time where supported by the registry.
Account
You must register an account to use our services. All information provided during registration must be accurate, complete, and kept up to date. You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
Payment
All prices are listed in euros (EUR) and exclude VAT unless stated otherwise. Billing cycles are monthly, quarterly, or annually depending on your chosen plan. We accept iDEAL, SEPA direct debit, Visa, Mastercard, and cryptocurrency payments.
Invoices are due upon receipt. If payment is not received within 7 days of the due date, we reserve the right to suspend your services. Suspended services may be terminated and data deleted after 14 days of non-payment.
Service Level
We guarantee 99.9% network uptime on a monthly basis, excluding scheduled maintenance. If uptime falls below this threshold, you are eligible for service credits proportional to the downtime experienced. Scheduled maintenance windows are announced at least 48 hours in advance via email and our status page.
Acceptable Use
You may not use our services for any unlawful purpose. The following activities are strictly prohibited:
- Hosting or distributing illegal content under Dutch or EU law
- Sending unsolicited bulk email (spam)
- Distributing malware, running botnets, or conducting network attacks
- Excessive resource consumption that degrades service for other customers
- Cryptocurrency mining on shared or VPS infrastructure unless explicitly permitted
Violations may result in immediate suspension or termination without refund.
Data & Privacy
We process personal data in accordance with the General Data Protection Regulation (GDPR) and Dutch data protection law. For full details on how we collect, use, and protect your data, please refer to our Privacy Policy. You remain the data controller for any data you store on our infrastructure.
Liability
Our total liability for any claim arising from your use of our services is limited to the fees you have paid to us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages including loss of data, revenue, or business opportunities.
We are not liable for failures caused by events beyond our reasonable control, including but not limited to natural disasters, power outages, network failures, or government actions (force majeure).
Termination
Either party may terminate services with 30 days written notice. We may terminate or suspend services immediately and without notice if you violate these terms or engage in prohibited activities. Upon termination, you are responsible for retrieving your data before your service is deactivated. We retain backups for a limited period at our discretion.
Modifications
We may update these terms from time to time. Material changes will be communicated at least 30 days in advance via email or a notice on our website. Continued use of our services after the effective date of any changes constitutes your acceptance of the revised terms.
Governing Law
These terms are governed by the laws of the Netherlands. Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.
